Terms and conditions
I. Initial provisions
These terms govern the relationship between the visitor (hereinafter referred to as the User) of the website iqtest-certification.com (hereinafter referred to as the Server) and the company tesicom s.r.o. (hereinafter referred to as the Provider), with its registered office at K Horomericum 1184/41, 165 00 Prague 6, identification number 27512151, registered in the Commercial Register maintained by the Regional Court in Hradec Kralove, Section C, Insert 23416.
The legal relationship governed by these terms and conditions starts at the point when the User fills in a test on the Server and pays a fee for provision of results of the test.
By sending the payment for provision of the results of the test, the User accepts the Terms and Conditions.
II. Definitions
Intelligence quotient – or IQ, it is the measure used as output of standardised IQ tests to describe a person's intelligence compared to the rest of the population
IQ test ID number – each test is identified by its own unique number. The ID number is generated after the completion of the whole test. The number if used for returns or for later recalls of the test scores.
III. User's rights and obligations
The User can at any point contact the Provider by email or phone to request that all his personal data is deleted from the database. This shall be completed within three days from the receipt of the request.
The user acknowledges that the webpage does not have to be accessible all the time, especially with regards to the necessary hardware and software maintenance.
The User agrees that the Provider can send business messages to his/her email.
IV. Provider's rights and obligations
The Providers is not responsible for outages or restrictions of services resulting from actions by third parties, force majeure or due to problems with equipment of other suppliers (e.g. electricity or telecommunication outages}
After completion of a test and payment for the test, the Provider shall allow the User access to results of the test, especially to the intelligence quotient, and he shall allow him to generate a PDF certificate. The certificate shall contain User's name and intelligence quotient.
The Provider shall not be held responsible for any damages resulting from completion or assessment of IQ tests. The User acknowledges that the test results are for information only and a different result can be obtained in different IQ tests.
V. Data protection
The Provider declares that he does not collect any personal data about IQ test users. The name and surname that the user fills in to print out his/her certificate are not stored and are only used by the User to print out the certificate.
VI. Data protection and agreement for sending of business messages
The Provider confirms that while gathering and processing data, he complies with Act no 101/2000 Coll., on data protection.
The User, who is a physical person, consents to processing of the following personal data: name, surname, email address, phone number, age, IQ score (together
"personal data“
).
The User consents to processing of personal data by the Provider for reasons of evaluation of the IQ test and in order to comply obligations resulting from the service agreement and for forwarding of business information.
User's Personal Data can be transferred to third parties or overseas. The Provider can transfer the processing of User's personal data to a third party as a processor.
The personal data shall be process for an unlimited period and should the User require them to be deleted, they will be deleted from the database within 48 hours from the delivery of the request to the Provider.
The User agrees that the Provider can email him notices, including notices about changes in these Terms and Conditions, business messages including business messages from third parties.
VII. Payment terms
For the provision of the test result, the User is obliged to pay the Provider a fee of $8.99.
The fee is payable via the Stripe payment service no later than 14 days after completing the IQ test. If the fee is not paid within this period, the User’s right to receive the result of their IQ test expires.
VIII. Cancellations / Returns
A user acting as a customer according to Article 52, paragraph 3 of the Act No 40/1964 Coll., Civil Code, as amended by subsequent regulations ("Civil Code“) shall in accordance with Article 53, paragraph 8, point a) of the Civil Code have the right to cancel the Agreement only up to the point when the Provider starts to fulfil his obligations resulting from the Agreement.
The User has the right to withdraw from the contract and request a refund (provided that the full payment has been successfully completed and the Provider has actually received the fee). To successfully process a complaint, the User must send the following information to the Provider’s email address (support). The subject line of the message must include the text “Withdrawal from Contract.” In the body of the message, the User must state their full name, the email address from which the payment was made, the date of payment, and the User’s bank account number.
IX. Final provisions
All content of the Server and the format of this content and its part are subject to copyright according to Act No 121/2000 Coll., Copyright Act, as subsequently amended, and according to the relevant copyright regulations each individual use without an author's or owner's licence constitutes a breach of copyright and constitutes a criminal offence.
The Provider reserves the right to change these Terms and Conditions at any point without User's previous consent by publishing their new and full version on the Server. The new Terms and Conditions shall become valid on publication unless the Terms and Conditions contain a later effective date.
The Provider is not responsible for any activities of Users of the Server nor is he responsible for the way they use the Server.
These Terms and Condition become effective on 1. 7. 2018.
